Terms and Conditions of Big Bang Injection GmbH
I. Terms and Conditions§ 1 Miscellaneous provisions(1) The following provisions are valid for all contracts that are concluded with the provider (Big Bang Injection GmbH) via the homepage www.bigbanginjection.com. General terms and conditions of the customer are herewith expressly contradicted..(2) Consumers according to the following regulations are all natural persons who make a transaction that is not for industrial activity. Contractors are all natural persons or juridical parties that act for their industrial or self-employed activity.
§ 2 Conclusion of contract(1) Purpose of the contract is selling products.Our online products are noncommittal and are not a binding offer for a conclusion of a contract.
(2) You can place a binding offer (order) in our online store shopping cart system. During that process all goods that you intend to buy are moved into the cart. With the appropriate button in the navigation bar you can get to your cart to make changes.
After proceeding to checkout, entering all personal, payment and shipping details you will finally get a summary of all order details.
If you use PayPal by clicking on the integrated button in our online store system you will get to the Log-In site of PayPal. After successfully logging in, your PayPal address and payment details will get visible. After finishing the PayPal payment, you will get back to our online store´s summary of order details. Before finishing your order, you have the chance to check all your entered details. By clicking the button “place your order” you place a binding offer.(3) The acceptance of your order (contract) will be immediately after placing your order and you will get a confirmation email with all your order details. If you did not get such a confirmation email your offer is not binding and all work performed can be refunded.
(4) All your inquiries to make an offer are not binding. All offers referring to your inquiry are binding and normally valid for 5 business days.(5) The processing of your order and the exchange of all relevant data referring to your order is handled via email, partly automated. For that reason, you have to take care that your entered email address is correct and receiving emails is technically possible and our emails are not blocked by your SPAM filter.§ 4 Right of retention, reservation of proprietary rights(1) You only have a right of retention if you have a claim about the same contractual relationship.(2) All goods remain the property of the company Big Bang Injection Gmbh until they are fully paid.
§ 5 Complaints and Liability In the cases where the buyer has a right of complaint, it shall be lodged in writing within 14 days of receipt of the goods at the destination. Defects which cannot be detected even given the closest examination within this period shall be notified without delay upon discovery with the immediate cessation of any handling or processing, at the latest however six weeks from receipt of the goods. If an item is defective, we shall be entitled at our own discretion to supplementary fulfillment in the form of removal of the defect, return delivery for a replacement free our plant, a reduction in the purchase price or its reimbursement. In the event of return delivery, our order number shall be indicated on the bill of freight, in the dispatch documents and on the bill of conveyance. Any damage claims above and beyond this of whatever kind and from whichever title, especially such relating to compensation for direct or indirect damage, such as loss of profit, are expressly ruled out.§ 6 Place of performance and jurisdiction
The place of performance for all transactions, even if carriage paid to point of delivery is agreed, shall be the supplying plant. The place of jurisdiction for all disputes is Vienna exclusively, although we are also entitled at our discretion to go to any other court which is competent in relation to the buyer.
The contract is subject to Austrian law with the exclusion of CISG.

As long as you are a consumer, all possibilities of accidental perishing or degradation of the sold items during shipment will be at our risk until to the point that the items are delivered and accepted by the consumer. It does not matter if the shipment is insured or not. This is not the case if the customer organized shipping or delegated a third party for the transport.
